Draft Translation of the new Amnesty Law
14.03.2007 Due to the fact that peoples’ Jihad, resistance and rightful struggles for the sake of defense of religion and fatherland have been our country history’s glorious ascendancies and are accounted our manifest national attributes and on the other hand realization of national reconciliation, excision of war and bloodshed, strengthening national unity and creation of trust opportunities among all social stratums is considered an indispensable obligation. Thus, for the sake of apprehension of it the following orders are sanctioned:

First Article:

This resolution is passed for the sake of strengthening of reconciliation and national stability, securing country’s territorial integrity, cessation of animosities and creation of trust for all outbreak fronts, based on their safety with regard to the respect to constitution and prevailing laws of the country.

Second Article:

National Assembly of Afghanistan, for the sake of strengthening peace and stability and ending battle, invites all the armed groups who are against the Islamic Republic Government of Afghanistan to join the Peace and National Reconciliation process and take part in strengthening the system and reconstructing the country.

Third Article:

1. All the political wings and hostile parties who had been in conflict before the formation of the interim administration, for reunion among different stratums of society, strengthening peace and stability and commencement of a new life in Afghanistan’s contemporary political history, are included in the national reconciliation and amnesty, hold their legitimate rights and will not be pursued legally or judicially.
2. Those armed individuals and factions who have been opposing the Islamic Republic of Afghanistan and after the endorsement of this resolution, ceases their armed opposition and who respect the Constitution and the prevailing laws of the country are entitled to benefit from the privileges of Article 2 of this Charter.
3. Item (1, 2) of this article’s decrees does not intrigue individual rights disputes and person to person punishment regarding individual crimes.

Fourth Article;

1. Those individuals who, for the sake of committing crimes against internal or external security of the country, are under judicial pursuit can not benefit from the premiums of this charter.
2. Those individuals that the courts have ordered for their committal of crimes against internal or external security of the country, based on the proposal of the strengthening of peace commission, and in case of swearing of those individuals regarding NOT renewal of their activities against the Islamic republic of Afghanistan and assurance of that commission, under separate decree will be considered for forgiveness or remission of punishments.

Fifth Article:

In order to help end violence and distrust between the government and the opposition armed groups, and strengthening stability and national reconciliation, an extraordinary commission will be appointed by the National Assembly, to cooperate with strengthening peace commission to create ground for their [armed opposition groups] union to stability and national reconciliation process.

Sixth Article:

This resolution is dominant from the date of its signature and be printed in the official gazette.
